Under Massachusetts law, an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 2D of chapter 128 of the General Laws.

BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING ON THE PROPERTY OF, USE OF THE OWNER’S HORSE, AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT THE PROPERTY OF Melissa Albert and Rob Lindberg at 200 Easthampton Road, Westhampton, MA 01027.

I, on behalf of myself, my personal representatives, heirs, assigns, beneficiaries, successors, spouse, and/or next-of-kin, hereby specifically forever waive/agree to indemnify, release Melissa Albert and Rob Lindberg, and any of their principals, agents, representatives, heirs, and/or family members for any and all liability, of any nature, for any and all injuries and/or damages that I sustain (regardless of whether the nature of the injuries and/or damages that I sustain is specifically listed above) as a result of participation in any equine activities at the property at 200 Easthampton Road, Westhampton, MA 01027.

I, on behalf of myself, my personal representatives, heirs, assigns, beneficiaries, successors, spouse, and/or next-of-kin, hereby specifically forever waive/agree to indemnify, save and hold harmless Melissa Albert and Rob Lindberg, and any of their principals, agents, representatives, heirs, and/or family members, from and against any loss, liability, damage, attorney’s fees, or costs that they may incur arising out of or in any way connected with either my presence or participation on their property located at 200 Easthampton Road, Westhampton, MA 01027.

If I am present at and participate in the activities at 200 Easthampton Road, Westhampton, MA 01027, I do so at my own risk, and I hereby acknowledge and agree that Melissa Albert and Rob Lindberg, and any of their principals, agents, representatives, heirs, and/or family members, shall bear no responsibility or risk associated with injuries that could arise from my presence at this property. I have read this Agreement and made this waiver voluntarily. I understand that by signing this document, I am waiving legal rights, including any and all rights that I may have against Melissa Albert and Rob Lindberg, and any of their principals, agents, representatives, heirs, and/or family members.
